Consequences of Restraining Orders

When a domestic violence allegation is made against you, you will most likely have a restraining order issued against you. There are two stages that restraining orders go through. The consequences of your restraining order will depend not only on the circumstances of your case but also on the stage at which the restraining order has reached.

Temporary restraining orders (TRO)

When the alleged victim accuses you of domestic violence, they will be interviewed by a court staff member. This interview is to establish whether the case qualifies as a domestic violence case. The alleged victim may then go before a judge to request a restraining order against you. If the judge believes that a restraining order is necessary to protect the alleged victim, they will enter a temporary restraining order against you. You as the accused are not entitled to notice. Law enforcement will be sent to hand deliver the restraining order to you.

Final restraining order (FRO)

The judge will set the date for a hearing after issuing the TRO. This hearing ought to be within 10 days of issuance of the TRO. In this hearing, you will have the opportunity to defend yourself against the allegations against you. If the judge feels that there is a need for protection, they will enter a final restraining order against you.

There are various restrictions that a judge can order. These include:

  • Prohibiting you from going to the property where the alleged victim lives even if it is your home
  • Prohibiting you from going to the alleged victim’s workplace
  • Prohibiting all forms of communication or contact with the accuser e.g. you may not communicate via text messaging or even through social media.
  • Ordering you to pay child support to the alleged victim
  • Ordering you to pay emergency funds to the alleged victim
  • Requiring you to surrender your firearms even when they are duly registered
  • Loss of custody of your children
  • Paying a fine of between $50 and $500 as a penalty
  • Having your fingerprints taken
  • Having to undergo rehab, counseling, or other forms of therapy or treatment for addictions and substance abuse.
